ACTA - comments and links

ACTA is an Anti-Counterfeiting Trade Agreement which is currently negotiated on an international level. This information is designed to give a better understanding about the European Union’s policies with regard to ACTA. It will not repeat what others have done already and what is public available on the web but it will connect to those websites which are informative, correct and reliable.

I was a Member to the European Parliament until Summer 2009; since then I stay connected through various channels with certain areas of European policy making, specifically those which relate to the Internet. In my professional capacity I work with the Computer & Communication Industry Association (ccianet.org) based in Washington and Brussels.

The most comprehensive information about ACTA comes from Michael Geist (michaelgeist.ca) a Canadian law professor at the University of Ottowa, he holds the Canada Research Chair in Internet and E-commerce Law.

Michael Geist website looks into the effect ACTA will have on the legislative environment not just for Canada but for other countries as well.

Update 23.3.2010

The European Commission hosted a fascinating consultation on ACTA today.  Luc Devigne, the lead European negotiator, opened with a brief presentation and proceeded to field questions for over an hour.  The full consultation video is available online.  The discussion touched on many issues including Devigne arguing that the WTO consistently blocked any attempt to address IP enforcement issues and stating that the treaty is limited to enforcement and not new substantive provisions (this assumes that anti-circumvention rules are a matter of enforcement, not substance).

ACTA ist ein sehr interessantes Thema wenn man die Aussenpolitische-Dimension einbezieht. Dies wird meistens übersehen - ist meiner Meinung nach der intessanteste Aspekt.

Warum:

1) aussenwirtschafltiche und aussenpolitische Themen kann man kaum trennen - die intellektuelle und analytische Kapazität der EU ist nicht ausreichend vorhanden, die Dimension eines solchen neuen Abkommens in allen Dimensionen zu überblicken;

2) die Vorstellung, dass ein Abkommen mit den erwähnten Staaten eine Sogwirkung auf China, Indien oder Brasilien ausüben würde, ist nahezu naiv;

Ich bin ein grosser Freund von Handelsabkommen, aber sie müssen wirklich sinnvoll sein und dem eigenen Wirtschaftraum und der Gesellschaft insgesamt auch Vorteile bringen. Dieses sehe ich nur in einem sehr begrenzten Ausmass bei ACTA gegeben.
